The regular meeting of the Tunkhannock Township Board of Supervisors was called to order at 7:06pm by Co-Chairperson Maureen Sterner.
Held after October 8, 2008 Regular Meeting, after the October 22, 2008 work session, before this evening’s meeting and after this meeting for legal and personnel issues.
The following minutes were presented and approved with a motion by Supervisor Davenport, seconded by Supervisor Sterner. There being no comments or questions the motion passed unanimously.

No comments or questions came before the board on any agenda items, Secretary Wieand read the following announcements: A Letter from Paradise Township giving the IMBC until December of 2009 to review the joint agreement etc. Letters were received from Solicitor Lyons regarding tax exemption follow-up for Kim, Moyer, and Mt Terrace property owned by the Township.
Following a previous executive session the Board of Supervisors agreed to have Solicitor Lyons offer a settlement to Mr. Robert Beers registered survey, to pay half of the final balance owed him on the Kim property survey. Supervisor Davenport made a motion pay the balance owed Mr. Beers for $641.15. Seconded by Supervisor Sterner and carried unanimously. Solicitor Lyons updated the Board on the Boyskey Zoning hearing board decision and advised the board that Zoning Ordinance 2005-103 needs to be amended and he will cover this under item six (6) on the agenda tonight. The Wildlands Conservancy walking easement can be granted to a non-profit organization and Solicitor Lyons recommends that the Board request in writing from DCNR and MC Planning that they also approve the walking easement on the Fern ridge Bog to the Maple Tract.
Timber Bid: Two (2) bids were received on November 12, 2008, one at 11:40am from Roger Meckes for $250 and the second at 1:03pm by Yard & Lawn Service-Firewood Headquarters for $2,651. All documents requested were received, opened and recorded at 2:20pm by Secretary Wieand, witnessed by Kate Lambert and James Davenport. A motion by Supervisor Sterner to accept the highest bid in the a mount of $2,651 from Yard & Lawn Service Firewood Headquarters and allowing them 30 days to remove the wood from the property. Seconded by Supervisor Davenport, and there being no comments or questions the motion passed unanimously.
A letter from Engineer Kevin Harrison regarding the Stoltzfus Farmers Market was received and reviewed by the Board. Solicitor Lyons reviewed his letter to Mr. Stoltzfus with the requirements for Phase II and the completion to be done by June of 2009.
A draft of the recommended Ordinance Amending Zoning Ordinance 2005-103 Article II section 202, Article III section 307 (A), adding to Article IV Section 49, subsection (h), amend Article VII Section, 806 and 806 (A) and amend Section 807 (A) & (B). This comes on a recommendation of our Solicitor after the Zoning Hearing Board case against Boyskey, those items and charts were missing from these sections in the Ordinance. A motion by Supervisor Sterner to have a Public Hearing on December 17, 2008 at 6:45pm followed by a Special Meeting. Seconded by Supervisor Davenport and carried unanimously.
On Monday November 10, 2008, Planning and Grants administrator Dot Trauger mailed the request for incidentals on the Silver Property, closing the grant for final payment. We are expecting the reimbursement of approximately $15,167.67 for incidentals and the approved grant amount forthcoming in the amount of $244,000 granted by DCNR. The Township will reimburse the Capital Reserve for the monies borrowed to close on the loan once the Grant is received from DCNR.
A letter received by MCCD (Monroe County Conservation District) in response to our letter from October 31, 2008 regarding Mt. Terrace Estates was reviewed. The MCCD will follow and complete an inspection in the not to distant future.
A request from Mr. & Mrs. Stephen Foggia via the assessment office was received and reviewed by our office and determined that they were double billed and paid twice on the building located on Parcel 20/8C/1/104 and a refund for Township tax is $317.71. Supervisor Sterner motioned to refund the Foggia’s Township Tax in the amount of $317.71, seconded by Supervisor Davenport and carried unanimously.
A recommendation from Planning & Grants Administrator Dot Trauger, and Secretary/Treasurer Maria Wieand to better serve the Township and increase revenue, it is being suggested that we follow our mandated commercial recycling ordinance. In doing so, they are requesting to move forward and notify commercial properties within the Township and the Commercial waste haulers that recycling is mandatory and as stated in the recycling ordinance. According to our findings, only two waste haulers are currently reporting commercial collection from our Township. Supervisor Sterner made a motion to move forward in notifying commercial businesses as well as commercial waster haulers that commercial recycling must be collected and recorded to the Township as stated in the ordinance for 2009 and forward. Seconded by Supervisor Davenport and carried unanimously.
Supervisor Davenport made a motion to hold a budget work session on Wednesday 11/26/08 at 5pm and the advertising for the adoption of the 2009 budget meeting to be help on December 17, 2008 at 7pm. Seconded by Supervisor Sterner and carried unanimously.
F. Public Comments
Gil Werner- questioned if residents of Emerald Lakes can still dump brush at the Township and can all residents meaning those in other Townships of Emerald Lakes Community also bring their bush to us? The board said they would need to discuss this further. Residents of the Township may continue to bring residential brush to the Municipal complex and the office will instruct you to the location of dumping. Since the recreation leased property from BWA had to be cleaned up we can no longer store the brush at that location. A temporary area has been designated or residents may take their brush directly to Coolbaugh Township Municipal Yard. Gil would also like a copy of the recycling vendors for various items in the county. He couldn’t get a list from MCMWA and Secretary Wieand said she had a copy she will get it to him.
Joseph Olall- would like to know if we have made a decision on the computers and the skype phone system. Supervisor Sterner commented that we would be going with Access Technologies and no we haven’t looked at the Skype System.
Meeting was adjourned at 8:31pm motioned by Supervisor Davenport and Seconded by Supervisor Sterner.
