MINUTES OF THE TUNKHANNOCK TOWNSHIP BOARD OF SUPERVISORS

REGULAR MONTHLY MEETING HELD DECEMBER 12, 2005

The Tunkhannock Township Board of Supervisors held their regular monthly meeting on December 12, 2005. Those in attendance were Supervisors Francis Altemose, II, Jim Sterrett and William Bourke, Secretary/Treasurer Donna Verdes, Solicitor Ed Scacchitti, Roadmaster Bruce Walder, Asst. Secretary, Zoning & Sewage Bev Riker and area residents. Chairman Altemose, II called the meeting to order at 7:30 PM.

The following minutes were presented: November 7, 2005 regular monthly meeting, November 23 and December 5, 2005 work sessions and November 7 and November 23, 2005 budget work sessions. Chairman Altemose, II stated that Executive Sessions were held on November 16, 2005 and November 23 following the budget work session for personnel reasons. Motion by Chairman Altemose, II to approve the minutes as written. Motion seconded by Supervisor Sterrett. There being no comments. Motion passed unanimously.

Special Presentation: Tunkhannock Township Volunteer Fire Co. Chief Kevin Long and members presented Supervisor Bourke with a plaque thanking him for his service to the Township and Fire Co. The Fire Company recognized Bill's considerable knowledge of government and financing. The biggest achievement was the new fire house. The sentiment was "thank you and sorry to see you go". The inscription read: In appreciation and recognition of his outstanding community service and support of the Tunkhannock Township Volunteer Fire Company the designation of Honorary Member is bestowed upon William Bourke December 12th, 2005.

Supervisor Bourke thanked everyone and said it was an honor and he tried to do what was best for the Township and the Fire Co. since he's been in office. He mentioned that the new Fire house was probably the biggest achievement and he hoped the fire company prospers in the future. A group photo was taken.

Matters Arising: Henning Survey Costs Approved - Donna Verdes stated that at last month's meeting Marie Rivera had a question in regard to the Barry Islett & Associates bill regarding the Henning Survey. She thought the Supervisors at a previous meeting had approved that it be completed for less than $6,000. She also believed we paid $5,900 at a previous meeting. Therefore, why was the Township spending an additional $3,900. Donna Verdes explained that on August 8, 2005 the Board of Supervisors approved a motion for an expense of approximately $9,750.00 for the Henning Survey. The total amount paid to Barry Isett & Assoc. was $9,792.58. $5,892.58 deposit in October and $3,900.00 for the balance due in November.

Health Insurance Percentage Increases: Donna Verdes stated that at last month's meeting Marie Rivera asked what the percentage of increase for the health insurance. Donna Verdes explained that the increase was 15.2%.

Treasurer's Report: Treasurer Donna Verdes presented the Treasurer’s report

General - Receipts $137,800.06

Disbursements $ 88,561.79

General Balance $553,885.78

Liquid Fuels - Liquid Fuels Balance $370,897.72

Motion by Supervisor Bourke to accept the treasurer’s report. Seconded by Supervisor Sterrett. After comments, motion passed unanimously.

Bills in the amount of $46,368.620 were presented. Supervisor Bourke pointed out that the bill list was printed twice pages 1, 2 & 3. Also on page 4 the last page on the bottom on the page where it says Capital Reserve Fund it should say Liquid Fuels Fund. Motion by Chairman Altemose, II to approve the bill list. Seconded by Supervisor Sterrett. After comments and questions, motion passed unanimously.

Announcements – Supervisor Sterrett announced the following:

- Clymer Library Book Mobile is every other Wednesday 2:30 - 3:30pm at Willie's Deli at the corner of Route 115 and Mountain Road (December 21, 2005 & January 4, 2006)

Supervisor Bourke read the meeting schedule.

Old Business:

Proposed Mountain Terrace Estates Road Maintenance Letter of Credit. - Supervisor Sterrett explained that at last month's meeting P & K Developers in regard to Mountain Terrace Estates requested that the Township accept certain roads including Mt. Terrace Drive, Arthur's Way and Bruce Lane. The Roadmaster, Township Engineer and Solicitor reviewed the roads and/or the deed of dedication. The roads were accepted. Now we have to put in place a road maintenance bond.

Motion by Supervisor Sterrett to accept P&K Developers, LLC Road Maintenance Bond for Mountain Terrace Estates in the amount of $73,012.80 in lieu of the preceding letter of credit. This Road Maintenance Bond is in agreement with the Township's Subdivision and Land Development Maintenance and Guaranty Agreement. Seconded by Supervisor Bourke. After comments motion passed unanimously.

New Business:

Proposed Resolutions Disposing of Records According to Statutory Requirements - Chairman Altemose, II explained that Bev Riker in conjunction with the Historical Society has worked to dispose of old records, no longer necessary to keep. Therefore, we would like to dispose of records according to statutory regulations.

Motion by Chairman Altemose, II to adopt Resolution 2005-108 whereas Tunkhannock Township intends to follow the schedules and procedures for disposition of records as set forth in the Municipal Records Manual approved on July 16, 1993. After comments and questions, motion passed unanimously.

Chairman Altemose, II further stated that the public records to be disposed are from 1976 - 2000 they include for example accounting records, tax records, employment applications of people not hired, unnecessary administration reports from other agencies state, county and local, out of date: publications, school bus routes, insurance cards, 1999 records retention guide, Clymer Library newsletters, PP&L annual report. Police correspondence, citations and general correspondence etc. All of which is described in Exhibit "A".

Motion by Chairman Altemose, II to adopt Resolution 2005-109 whereas Tunkhannock Township in accordance with Act 429 of 1968 intends to follow the schedules and procedures for disposition of records as set forth in the Municipal Records Manual approved on July 16, 1993. Hereby authorizes the disposition of the public records as described in Exhibit "A". Seconded by Supervisor Bourke. After comments and questions, motion passed unanimously.

Reports: Chairman Altemose, II stated the EAC minutes were not completed yet for November, The Joint Open Space meeting was cancelled. The COG and EMA had no meeting.

EMS - Supervisor Sterrett stated that the EMS will be posted .

Clymer Library - Bill Chatham stated they were wrestling with the budget and it should be approved this week.

Regional Comprehensive Use Plan & Joint Building Codes - Supervisor Bourke stated there was no meeting and the Pocono Mountain Regional Police Board would be finalizing their budget Tuesday.

Mike Gillen - Mention that the Pocono Record had an interview with one of our Regional Officers who is serving in Iraq, Will Laverty.

Donna Verdes stated that the Monroe County Task Force minutes were posted. Dot was out today and if there are any Planning Commission minutes they will be posted tomorrow.

Public Comments:

Peggy Yencho - passed

Mike Gillen – commented on the Abandoned car Resolution that was forward to the Planning Commission. It was passed back to the Board of Supervisors with no recommendations.

Betty Terrell-Cruz - requested the Board of Supervisors seriously look at setting up a committee to determine how enforcement can be beneficial to township. The Top of the Mountain Democratic Club has food baskets for anyone who needs help. She thanked the Supervisors for their hard work and wished everyone a Merry Christmas. She also thanked Supervisor Bourke for his patience.

Bill Bourke - It's been a great six years and a wonderful experience. It's been an honor and privilege to serve as Township Supervisor.

There being no further public comments, Supervisor Bourke made motion to adjourn the meeting. Seconded by Supervisor Sterrett. Motion passed unanimously. The meeting adjourned at 8:12 p.m.
