MINUTES OF THE TUNKHANNOCK TOWNSHIP BOARD OF SUPERVISORS
REGULAR MONTHLY MEETING HELD APRIL 9, 2007
The Tunkhannock Township Board of Supervisors held their Regular Meeting on April 9, 2007. Those in attendance were Supervisors' Richard G. Van Noy, Jim Sterrett, and Francis A. Altemose, II, Secretary/Treasurer Donna Verdes, Solicitor Ed Scacchitti, and area residents. Chairman Van Noy called the meeting to order at 7:01pm.

Motion was made by Supervisor Altemose, II to accept the minutes and seconded by Supervisor Sterrett. There being no further comments the motion passed unanimously.
Chairman Van Noy announced that Executive Sessions were held after March 12, 2007 and after the April 2, 2007 work session for personnel & legal reason.

Treasurer's Report: Treasurer Donna Verdes presented the Treasurer’s report
General Fund: Receipts $558,705.49
Disbursements $112,169.74
General Fund Balance: $667,187.57
Liquid Fuels Balance: $210,912.09
Motion by Supervisor Altemose, II to approve the Treasurer’s report. Seconded by Supervisor Sterrett. There being no comments the motion passed unanimously.
Bill List: Bills in the amount of $297,926.72 were presented. Motion by Supervisor Sterrett approve the bill list. Seconded by Supervisor Altemose, II. There being no comments the motion passes unanimously.

Chairman Van Noy read the meeting schedule.
Old Business:
- Proposed Public Hearing for Rezoning from C1 to R1 - Last year the Township rezoned approx. 55 acres along Long Pond Road from R1 to C1 at the request of Angelika Homes to promote commercial development. The developer agreed to convey approx. 30 acres to the Township for Open Space purposes. Despite repeated efforts by the solicitor to obtain, the deed for the 30 acres there has been no response from the developer. The property is now listed for public sale and the Township wishes to change the zoning back to R1. A motion by Supervisor Altemose, II, to advertise a Public Hearing to be held on May 14, 2007 at 6:45 p.m. in regard to Tunkhannock Township Board of Supervisors to request a zoning change from C1 back to R1 for those properties on Long Pond Road. The Supervisors also request the Planning Commission to review the said properties for the zoning change. Seconded by Supervisor Sterrett. There being no further comments the motion passes unanimously.
- John Kadany requested guidelines regarding employees “volunteering” their time, for no compensation, to complete tasks associated with their regular positions. Chairman Van Noy turned this over to council. Solicitor Scacchitti noted the law does not allow voluntary unpaid overtime. It is not addressed in the personnel policy and suggest that the supervisor’s review their policy handbook.
- Proposed Public Hearing for Transfer of Liquor License to Villa Virella Restaurant - Solicitor Scacchitti noted that by request of the applicant, they are not ready to proceed, and Council was authorized by motion to advertise it when paper work is in order. Once council gets that from applicant’s council, we will advertise for public hearing.
- Award Spring & Fall Bulk Trash Bid – A motion by Supervisor Altemose, II to award the Spring and Fall Bulk Trash to Carbon Services. Seconded by Supervisor Sterrett. There being no further comments the motion passed unanimously.
- Proposed Time Reality Event – A motion by Supervisor Sterrett to permit Time Reality to use the Township Park for a concert on June 30, 2007 from 9am – 8pm with the following conditions:
1. The event will be named Tunkfest sponsored by Time Reality.
2. Time Realty must provide the Township with a certificate of Liability insurance with limits of $1mil naming the Township as additional insured.
3. They follow the Rules & Regulations of the Park. i.e. cleanup and no alcohol must be strictly followed.
4. Sign a Hold Harmless Agreement.
Seconded by Supervisor Altemose, II. There being no further comments the motion passed unanimously.
- Proposed Resolution Approving Guardian Inspections New Fee Schedule – A motion by Supervisor Altemose, II to adopt Resolution 2007-107 approving Guardian Inspections New Fee Schedule. Seconded by Supervisor Sterrett. There being no further comments the motion passed unanimously.
- Proposed Oath of Office for Code Enforcement Officer - In order for Guardian Inspection Services to represent the Township before Magisterial District Judge Claypool they must take an Oath of Office as Tunkhannock Townships Code Enforcement Officer. A motion by Supervisor Altemose, II to approve Bill Weber on behalf of Guardian Inspection Services, Inc. to take the Oath of Office as Tunkhannock Township’s Code Enforcement Officer in all code enforcement proceedings. Seconded by Supervisor Sterrett. There being no further comments the motion passed unanimously.
- Proposed Amendment to Township Zoning Ordinance 2005-103 in regard to driveways. At the request of the Township Road Master Bruce Walder, standards for driveway construction were omitted when the township revised its Zoning Ordinance in 2005 and the prior standard must be required. A motion by Supervisor Altemose, II directing Kevin Harrison, Township Engineer to prepare an amendment to the Zoning Ordinance for Driveway construction to be reviewed by the Township Planning Commission with their comments to the Board of Supervisors. Seconded by Supervisor Sterrett. There being no further comments the motion passed unanimously.
- Proposed approval for Pocono Mountain West Little League to use Township Fields – A motion by Supervisor Sterrett granting permission for Pocono Mountain West Little League to use the three Township fields Monday – Sunday from 5pm to dark as per their request with the understanding that we would need a certificate of insurance naming the Township as additional insured.
- Proposed approval to advertise a public hearing for parking vehicles on public roads and highways – A motion by supervisor Sterrett to advertise a Public Hearing for parking on Public Roads during events at Pocono Raceway. Seconded by Supervisor Altemose, II. There being no further comments the motion passed unanimously.
- Proposed Transfer of Funds to Capital Reserve from General Fund – A Motion by Supervisor Altemose, II to transfer the funds back to Capital Reserve from the General Fund for dollars used for Moyer grant now that the funds have arrived from DCED. Seconded by Supervisor Sterrett. There being no further comments the motion passed unanimously.

Public Comments:
Marge Nowinski- Commented on taxes and fire company issues, and how the Township Residents should come to the meetings and voice their concerns.
Marie Rivera- Bill list review and would like to know how many dollars were spent on equipment for the roads and why additional monies paid out for surveying of Moyer property.
Donna Verdes- Liquid fuels explanation on how the liquid fuels are used and what percentages are allocated for what and when.
Motion to adjourn by Supervisor Sterrett seconded by Supervisor Altemose, II. There being no further comments the motion passed unanimously. Meeting adjourned at 8:12pm.
